Caught Drunk Driving?

The drunk driving laws as detailed in the Road Trafic Act 1988 makes it an offence to drive or attempt to drive a motor vehicle on a road or public place with more than the legal amount of alcohol in you breath, blook or urine.

What to do if you have refused to provide a sample for analysis

If you are caught for Drink Driving and refuse to provide a sample for analysis at the roadside or at the police station, you may think you have fefused to provide a specimen but technically you haven't.

Failing to provide a specimen for analysis is taken very seriously by the UK courts and they can impose a 5 year disqualification.

However, there are very strict procedures that have to be adhered to when taking a specimen and these may not have been followed correctly and therefore can be argued in court.
